Regarding the current presidential elections, there are no specific legal provisions concerning criminal prosecution, leading to a comprehensive and exhaustive pattern of national division.
In the case of a president who has successfully staged a coup... presidential orders remain in effect and are not invalidated during their term of office.
As a result of suspending indictment and trial through the privilege of immunity from criminal prosecution... if a guilty verdict is finalized after their term ends... the invalidation of the election eventually takes effect... while the reality is that all presidential orders remained in effect throughout the term.
Therefore, the relevant regulations must be amended to... either completely strip criminals of their right to stand for election, or... conduct pardon reviews before the presidential election... so that they may run for office only after being pardoned...
According to the "Hwang Hui Syndrome"... even criminals can be good at politics... so this is a matter that requires social consensus.
Whether it be through a national referendum, a resolution by the National Assembly as a representative body, or a decision by the Constitutional Court or the Supreme Court's en banc session... we must reach a clear conclusion regarding whether to allow suspects or defendants of crimes to run for election.
Furthermore, a list must be compiled ranging from minor offenses to serious crimes... to organize the legal framework regarding the extent to which the right to run for president should be granted despite criminal records.
There must be a fundamental blockade to prevent individuals involved in murder, parricide, crimes of internal/external rebellion, credit crimes, and accounting crimes from running for president.
