According to Article 17, Paragraph 2 of the Public Records Management Act,
"Public institutions shall prepare minutes, stenographic records, or audio recordings of major meetings as prescribed by Presidential Decree."
It is explicitly stated as "shall prepare" to prevent any wordplay.
This means they cannot avoid preparing them just because the meeting is private.
And among the major meetings prescribed by Presidential Decree,
3. Meetings operated with members holding major positions of Vice-Ministerial level or higher for the purpose of deliberating on major policies or coordinating opinions.
A private Blue House meeting where discussions regarding Leverage ETFs took place
should sufficiently fall under item number 3.
At the very least, claiming that there are no minutes because it was a private meeting
is highly likely to be illegal. Of course, they will probably play word games or insist otherwise.
