That trial is regarding a violation of the Public Official Election Act....
The charges involve Jae-myung's statement during the 20th presidential election claiming he did not know the late Director Kim Moon-ki,
and his claim that there was intimidation from the Ministry of Land, Infrastructure and Transport regarding the Baekhyeon-dong zoning change..
1st instance: Guilty, 1 year in prison (suspended for 2 years); 2nd instance: Not guilty;
3rd instance (Supreme Court En Banc): Remanded with a decision indicating guilt;
It has now returned to the 2nd instance High Court...
This is no longer a matter of determining guilt or innocence....
It is a trial to determine the sentence...
And.. there is no legal basis to withdraw the indictment for this trial...
Out of Jae-myung's 5 trials.....
1 has been closed with a not guilty verdict,
the other 3 are before the 1st instance sentencing...
The Public Official Election Act case we are discussing has already reached the 3rd instance...
So the indictment cannot be withdrawn (Criminal Procedure Act: Withdrawal of indictment is only possible before the 1st instance sentencing);
The problem is, if the fine comes out to 1 million KRW or more....
The Democratic Party will have to pay back the 43 billion KRW in election expenses reimbursed for the 20th election...
For other cases... it might be possible to withdraw the indictment, but...
For this one, they would have to change the Criminal Procedure Act itself... would that even be possible?.. The whole country would be in an uproar..
I personally think it's better for the Democratic Party if Jae-myung undergoes these trials while he is still in office...
