Please judge this accident: Car exiting a parking lot vs. Bicycle (Photos attached)
Hello, I am a woman in my 30s writing this to seek advice, as I heard there are many experts here on Bobae Dream..! ㅠㅠ
Please read my post and advise me on how I should handle this!
The photos below show the situation at the time of the accident.




A car suddenly drove out quickly from a building parking lot, crossing the sidewalk and the bicycle path, resulting in a collision with me while I was riding a Kakao Bike on the bicycle lane.
The collision occurred between the front wheel of the bicycle and the corner of the car's right headlight.
Since it was my first accident, I was startled, and because I was in a hurry to get to work, I only exchanged numbers on the spot and said I would contact him later; I couldn't file a report right then. ㅠㅠ
At the time of the accident, he was very kind, saying he didn't see me coming, apologizing, and asking if I was okay (he claimed he couldn't see me because of a car parked on the sidewalk, as shown in the photo).
However, as time passed and the tension wore off, my body began to ache. When I contacted him to process this through insurance because I needed to go to the hospital, his attitude changed instantly..
At first, he said, "My headlight is also damaged, so I'll fix that myself. Just go to the hospital once, show me the receipt, and I'll transfer the money. Why bother filing an insurance claim? If it doesn't hurt much, why don't you just endure it?"
When I told him I couldn't trust that and wanted to handle it cleanly through insurance, he started arguing, asking if I thought he was the only one at fault and if I was okay with being assigned negligence. He even tried to intimidate me by saying his car is a foreign model and repair costs would be high, so I told him I would file an insurance claim as well.
I have filed a claim with Kakao insurance, and the other party has filed for both property damage and personal injury.
(He claims he has no dashcam, and says the CCTV in that building parking lot is broken.)
There is CCTV that captured me riding on the bicycle path right before the accident site.
For your information, I checked the CCTV, and my speed was not fast.. ㅠㅠ
Naturally, the other party's insurance company told the driver that the fault would likely lie heavily on the car, but he is currently insisting on zero negligence.
Since I am using Kakao bike insurance, a claims adjuster from the non-life insurance company has already visited the site for an inspection.
I was so dumbfounded that I asked the Samsung Insurance representative (the car owner's insurer) why he was claiming zero negligence. He said the driver claims the bicycle speed was definitely fast, so he did nothing wrong.
When I asked the Samsung representative if they agreed with that, they said no, they had already informed him that the car holds more fault. However, they kept saying that since there is currently no dashcam or CCTV footage available and he refuses to admit negligence, there is nothing they can do.
The driver is with Samsung Fire & Marine, and both Samsung and my insurance adjuster are telling me to report this to the police..
I went to the police station to write a statement, and the officer contacted the driver. The driver said he really wanted to talk to me, so we spoke today, but he said, "Why did you go to the police? You have nothing to lose, right? Didn't you get treated well? This is something the insurance companies should settle; why did you report it?" He was actually being quite aggressive... When I told him his own insurance company told me to report it, he said they probably only said that because he's impossible to talk to. Samsung told me, "If your insurance company sues ours, it'll be over. Don't get stressed and just ignore him," and then he just hung up after saying whatever he wanted..
This is the situation. A formal police report hasn't been officially filed yet; should I just ask them to proceed with the report..? ㅠㅠ
It's hard enough being injured, but the stress is making it even harder...
