[Rumor] What would happen if Cho Hee-dae is impeached
What would happen if Cho Hee-dae is impeached
1. Cho Hee-dae's term lasts until next June. If impeachment occurs in November,
the impeachment trial will take at least 3 months.
In other words, from the end of this year to early next year,
his duties will certainly be suspended,
meaning all judicial functions, such as the En Banc sessions, and the appointment of new Supreme Court Justices
will all come to a halt.
The Acting Chief Justice would be Chun Dae-yeop.
He was a justice appointed by Kim Myung-soo, but
the consensus in the legal community is that he became a "patriotic conservative"(?)
after being severely harassed as the Minister of Court Administration during the early stages of the Lee Jae-myung administration's judicial reform.
2. If En Banc hearings are suspended,
not only the special prosecutor cases involving Kim Keon-hee, Han Duck-soo, etc., currently pending in the Supreme Court,
but also cases currently in the second instance involving
Yoon Suk-yeol, Oh Se-hoon, etc.,
will all be tied up in the Supreme Court until at least early next year.
Even if Cho Hee-dae returns to duty, considering the hearing period,
no trial conclusions can be reached before his term expires.
3. In this case, the new Chief Justice to be appointed by Lee Jae-myung
will inevitably have to finalize the cases. Unless an insurrection charge is finalized under Cho Hee-dae's court,
if the Chief Justice and Supreme Court Justices appointed by Lee Jae-myung
finalize the insurrection charge,
the possibility of non-compliance by the People Power Party and conservative factions becomes very high.
4. If the insurrection charge is finalized under Cho Hee-dae's court,
hardliners within the People Power Party, such as Jang Dong-hyeok, who argued for the presumption of innocence
and suggested waiting for the Supreme Court when Yoon Suk-yeol's insurrection charge was recognized in the first instance,
were likely to be cornered. However, if the charge is finalized under a Chief Justice appointed by Lee Jae-myung,
there is a high possibility they will grow in strength by refusing to comply,
and it seems unlikely that many within the party will be able to restrain this voice.
5. Given the current lineup of Constitutional Court Justices—Kim Bok-hyung (appointed by Cho Hee-dae),
Jung Hyung-sik (appointed by Yoon Suk-yeol),
Jo Han-chang (nominated by the PPP), and Kim Hyung-doo (moderate)—it is virtually impossible
to secure at least 6 votes to uphold the impeachment. The impeachment would be dismissed,
and the insurrection trials would simply be delayed.
