20-year-old sentenced to prison for spraying capsaicin on toilet paper and illegal filming in women's restroom

A 20-year-old social service agent, who installed micro-cameras in a commercial building's women's restroom to film illegally and sprayed capsaicin on toilet paper, has been sentenced to prison in the first instance.
The Seoul Central District Court (Criminal Division 16, Single Judge) sentenced 21-year-old Kim to 8 months in prison on charges of violating the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (filming using cameras, etc.) and injury.
The court also ordered the completion of 40 hours of a sexual violence treatment program and a 5-year employment restriction at institutions involving children, adolescents, and persons with disabilities.
The court noted that Kim had trespassed into women's restrooms for several months, filming up to four people per day, and that the videos included the victims' faces. The court pointed out that spraying bodily fluids inside the restroom and causing injury with capsaicin were sadistic and dangerous behaviors.
The court also criticized Kim for attempting to hide unfavorable evidence and items after receiving legal advice.
However, the court stated that the sentencing took into account that Kim reached settlements with the victims, surrendered to investigative authorities, and had no prior criminal record.
Previously, from January to April of this year, Kim was indicted for trespassing into a women's restroom in a commercial building in Sillim-dong, Gwanak-gu, Seoul, seven times to film illegally, and for spraying capsaicin on toilet paper in the same restroom this past April.
The prosecution had sought a 9-year prison sentence during the final hearing.
